The essentials

At a glance

  • A startup cost or accounting loss is not, by itself, a refundable ISR balance.
  • Pre-operational and operating companies need a review of their own filings and payments.
  • Keep the ISR analysis separate from pre-operational and operational VAT recovery.

Identify the income-tax position first

ISR is Mexico’s income tax. Its calculation, deductions, and treatment of losses sit within the Income Tax Law, while SAT’s business-refund process addresses supported tax credit balances and other applicable refund cases. An ISR recovery discussion should start by identifying the amount, period, and reason for the claimed balance.

Investment spending, an accounting loss, and a tax credit balance describe different things. They should not be combined into a general promise that a business can recover a percentage of its startup expenditure as income tax.

Before operations: organize the facts without assuming a refund

A company preparing to launch should record its expenditure, funding, payments, and filings accurately and obtain advice on their tax treatment. The treatment of pre-operational expenditure for ISR is a separate question from whether the company has a valid amount to request in cash.

If a credit balance or an undue payment is identified, the responsible advisers need to determine the proper basis and procedure for the particular case. If the issue is a loss or a future deduction, that discussion belongs in the income-tax planning workstream and should not be presented as an already established refund entitlement.

During operations: reconcile the calculation and payments

For an operating company, begin with the relevant income-tax filings and the reconciliation of amounts paid, credited, or withheld, as applicable to its regime. The review should explain how those amounts relate to the tax calculated for the period and to the balance being considered.

Have the team resolve differences between the tax schedules and accounting records before a refund application is prepared. A clear explanation of the origin of the amount is more useful than a spreadsheet showing a balance without its history.

  • Identify the period and the return establishing the position.
  • Reconcile tax calculations with the supporting schedules.
  • Trace payments and applicable credits to their evidence.
  • Review previous applications, adjustments, and uses of the same balance.

Keep VAT and ISR on separate tracks

A business may be reviewing several tax workstreams at once, but each needs its own calculation and supporting rationale. The investment narrative used in a pre-operational VAT review does not establish the company’s ISR refund position.

Give each workstream a separate owner, balance reconciliation, and application record. A shared project calendar can coordinate the work while keeping the underlying tax analyses distinct. That is particularly useful when the company is moving from establishment into regular operations.

A practical starting point with Miasky

Miasky helps organize the information, coordinate reconciliations with the relevant advisers, and maintain visibility over the application and follow-up work. The scope begins with understanding the actual tax position, rather than assuming the result.

Bring the relevant tax return, supporting calculation, payment history, and any prior application correspondence. Those records help the specialists distinguish a potential recovery claim from a matter of deduction timing, loss treatment, or accounting presentation.
